The Press Ombudsman has decided not to uphold a complaint made on behalf of Ms Jean Treacy that articles published in the Irish Independent on 25 January 2010 and 6 February 2010 were in breach of her privacy under Principle 5 of the Code of Practice for Newspapers and Periodicals. The complainant was a witness in a murder trial during the course of which evidence was given about many details of her private life. The articles published in the Irish Independent on 31 January and 6 February included general background information about the complainant’s childhood, school and family, as well as other material based on the evidence given by her in court. Any alleged breach of privacy has to be considered on its merits in the context of the Code of Practice.

A Woman and the Irish Daily Star

The Press Ombudsman has decided to uphold a complaint by a woman on behalf of herself and other members of her family that two articles in the Irish Daily Star about her father’s death on the day after he was buried were in breach of Principle 5.3 (Privacy) of the Code of Practice for Newspapers and Periodicals because they did not take the feelings of the grieving family into account in publishing the information. A number of other complaints about the articles were not upheld.
